What is an Employment Verification Letter?
An employment verification letter (EVL) is generally requested by an organization, such as a bank or landlord, to verify your current (or previous) job status and other details about your employment. The letter can also serve as supporting evidence for immigration purposes, such as when you’re applying for a green card or other visa.
Known by other terms — for example, “experience letter,” “proof of employment letter,” or “verification of employment” (VOE) — this letter should not be confused with the Employment Authorization Document , or EAD, commonly known as the “work permit.”

An employment verification letter is often required as evidence in immigration applications. Common situations include:
Applying for a green card
If you’re the sponsoring family member (the U.S. citizen or green card holder) on a family or marriage green card application, you’ll need to submit a financial support form (Form I-864, officially called the “Affidavit of Support”) to U.S. Citizenship and Immigration Services (USCIS). This form proves that you have sufficient financial resources to support the relative seeking a green card.
With this form, it’s important to provide supporting financial documents, such as an individual federal income-tax return, forms W-2 or 1099 (whichever is applicable), pay stubs (if employed), and an employment verification letter. The letter is especially important if you’ve recently switched jobs or if you’re combining your income with your spouse .
Self-employed green card sponsors
Immigration officers primarily rely on a sponsoring relative’s individual federal income-tax return for evaluating a family-based or marriage-based green card application, but some situations call for additional evidence to prove your eligibility to sponsor. This is especially true if you’re self-employed.
If you can’t provide a Form W-2 as financial evidence because you’re a business owner or an independent contractor, USCIS will still require an employment verification letter. You, however, must draft and sign the letter yourself. It generally should include the same information that would appear in a standard employment verification letter from an employer (see below for more details ). Some applicants choose to have the letter notarized, since the letter would be coming from you personally, but this is not required by USCIS.
Keep in mind that self-employed sponsors are often required to submit significantly more supporting evidence than would otherwise be necessary with a letter from a traditional employer. This additional evidence can include proof of your business’ existence (such as a state business registration or business bank account documents), contracts with clients, payment receipts from clients, and a corporate income-tax return.
Applying for a tourist visa
A B-2 visitor visa allows a traveler from another country to enter the United States temporarily as a tourist. When applying for this visa, USCIS will want to make sure that you:
- Have solid ties and will return to your home country after visiting the United States.
- Have the ability to financially support yourself during your trip to the United States.
An employment verification letter can prove that you’re employed in your home country and therefore have a job waiting for you upon your return. It can also prove that you earn an income through your employment, which will allow you to financially support yourself while you’re touring the United States. Applying for a work visa
There are multiple types of visas that allow people from other countries to work in the United States. Among these are the H-1B visa and the L-1A / L-1B intracompany transfer visa. For each of these visa categories, the purpose of the employment verification letter will be slightly different, but the focus of both letters should be your job experience.
Although not all H-1B visa applications require prior experience, USCIS will want to see your employment history . Evidence of this commonly includes your résumé or CV (curriculum vitae) but also an employment verification letter. In the L category, on the other hand, your eligibility for the visa not only depends on your ability to perform the duties of the position you seek, but also a minimum of one year’s experience prior to applying.
Applying for an employment-based green card
An employment-based green card generally requires an employment verification letter. Your eligibility for this type of green card strongly depends on your work experience, especially if the prospective employer indicates that past experience for the job is required.
Often more detailed and technical than an employment verification letter for a B-1 or B-2 visa, for example, the letter for an employment-based green card must describe your previous responsibilities in your previous jobs, in addition to your titles and dates of employment. The information in the letter is critical and can often mean the difference between approval and denial of your green card.
Applying for a temporary business visa
B-1 visas are intended for “Temporary Business Visitors” to the United States with (as you can guess) business-related purposes. Those purposes, however, may not involve doing actual work or receiving a salary from a U.S. source. Business visitors often come to attend meetings and seminars, negotiate contracts with business associates, appear as a guest speaker or lecturer, participate in training, or to purchase goods or property.
With a B-1 visa, you will need an employment verification letter to confirm your job status with your employer abroad and to describe the activities you’ll be participating in while in the United States. The letter should clearly state that you’re entering the United States only for a short visit, solely to engage in the activities described in the letter, and that you will not be working for or receiving payment from a U.S. source.
Although there’s no specific format required for the employment verification letter, it’s important to include the required details that the government needs to see. Some letters will require more detail than others, depending on the situation. But much of the information will generally be the same. It’s also important to ensure the accuracy of the letter — especially when submitting it as proof on a green card or visa application — to avoid delays or denial.
The letter should be written on your employer’s letterhead (or your own, if you’re self-employed), and should include the following key information (see below for templates ):
- Date the letter was written (must be within the previous 3 months prior to filing the green card application — the closer to the filing date, the better)
- Dates of your employment (start and end dates)
- Your job title
- Your employment classification (full-time, part-time, temporary, contract, or other)
- Your annual compensation (salary or wage)
- A description of your responsibilities, if applicable (see “ When It’s Needed ” above for situations that commonly require this information)
- A signature line showing the drafter’s signature, full printed name, and official title
Furlough or unemployment due to COVID-19 pandemic
If you’ve been furloughed or laid off due to the pandemic, the U.S. government will look for official documentation (notice) from your employer showing the date the notice was given, your name, your employer’s name, and date you expect to return to work, if applicable.
There are different ways to request an employment verification letter from a current or former employer:
- Ask your supervisor or manager. This is often the easiest way to request the letter. Just make sure to provide full details and context.
- Contact Human Resources. Some companies have formal processes that require going through the human resources department.
- Get a template from the company or organization requesting the letter. Sometimes, the people requesting the letter will provide their own template because it contains specific information they want. (USCIS does not provide a template for immigration applications.)
- Use an employment verification service. If it’s particularly difficult to get the letter from your employer, it may be easier to use a service that sends them your request. Some companies also use these services to streamline these types of processes. Every fiscal year (October 1 st – September 30 th ), approximately 140,000 employment-based immigrant visas are made available to qualified applicants under the provisions of U.S. immigration law. Employment based immigrant visas are divided into five preference categories. Certain spouses and children may accompany or follow-to-join employment-based immigrants.
To be considered for an immigrant visa under some of the employment-based categories below, the applicant's prospective employer or agent must first obtain a labor certification approval from the Department of Labor . Once received (if required), the employer then files an Immigrant Petition for Alien Worker, Form I-140 , with the U.S. Citizenship and Immigration Services (USCIS) for the appropriate employment-based preference category. (NOTE: Persons with extraordinary abilities in the Employment First preference category are able to file their own petitions.) Employment First Preference (E1): Priority Worker and Persons of Extraordinary Ability
There are three sub-groups within this category:
- Persons with extraordinary ability in the sciences, arts, education, business, or athletics. Applicants in this category must have extensive documentation showing sustained national or international acclaim and recognition in their fields of expertise. Such applicants do not have to have specific job offers, so long as they are entering the U.S. to continue work in the fields in which they have extraordinary ability. Such applicants can file their own Immigrant Petitions for Alien Worker, Form I-140, with the USCIS.
- Outstanding professors and researchers with at least three years experience in teaching or research, who are recognized internationally. Applicants in this category must be coming to the U.S. to pursue tenure, tenure track teaching, or a comparable research position at a university or other institution of higher education. The prospective employer must provide a job offer and file an Immigrant Petition for Alien Worker, Form I-140, with the USCIS.
- Multinational managers or executives who have been employed for at least one of the three preceding years by the overseas affiliate, parent, subsidiary, or branch of the U.S. employer. The applicant’s employment outside of the U.S. must have been in a managerial or executive capacity, and the applicant must be coming to work in a managerial or executive capacity. The prospective employer must provide a job offer and file an Immigrant Petition for Alien Worker, Form I-140, with the USCIS.
A Second Preference applicant must generally have a labor certification approved by the Department of Labor . A job offer is required and the U.S. employer must file an Immigrant Petition for Alien Worker, Form I-140 , on behalf of the applicant. Applicants may apply for an exemption, known as a National Interest Waiver , from the job offer and labor certification if the exemption would be in the national interest. In this case, the applicant may self-petition by filing the Immigrant Petition for Alien Worker, Form I-140, along with evidence of the national interest. Professionals Holding Advanced Degrees and Persons of Exceptional Ability receive 28.6 percent of the yearly worldwide limit of employment-based immigrant visas, plus any unused visas from the Employment First Preference category.
There are two subgroups within this category:
- Professionals holding an advanced degree (beyond a baccalaureate degree), or a baccalaureate degree and at least five years progressive experience in the profession.
- Persons with exceptional abilit y in the sciences, arts, or business. Exceptional ability means having a degree of expertise significantly above that ordinarily encountered in the sciences, arts, or business.
A Third Preference applicant must have an approved Immigrant Petition for Alien Worker, Form I-140 , filed by the prospective employer. All such workers generally require labor certification approved by the Department of Labor . Skilled Workers, Professionals, and Unskilled Workers (Other Workers) receive 28.6 percent of the yearly worldwide limit of employment-based immigrant visas, plus any unused visas from the Employment First Preference and Second Preference categories.
There are three subgroups within this category:
- Skilled workers are persons whose jobs require a minimum of 2 years training or work experience that are not temporary or seasonal.
- Professionals are members of the professions whose jobs require at least a baccalaureate degree from a U.S. university or college or its foreign equivalent degree.
- Unskilled workers (Other workers) are persons capable of filling positions that require less than two years training or experience that are not temporary or seasonal.
A Fourth Preference applicant must be the beneficiary of an approved Petition for Amerasian, Widow(er), or Special Immigrant, Form I-360 , with the exception of Certain Employees or Former Employees of the U.S. Government Abroad (see number 3 below). Labor certification is not required for any of the Certain Special Immigrants subgroups. Special Immigrants receive 7.1 percent of the yearly worldwide limit of employment-based immigrant visas.
There are many subgroups within this category:
- Broadcasters in the U.S . employed by the International Broadcasting Bureau of the Broadcasting Board of Governors or a grantee of such organization
- Ministers of Religion
- Certain Employees or Former Employees of the U.S. Government Abroad - Must use Form DS-1884, Petition To Classify Special Immigrant Under INA 203(b)(4) As An Employee Or Former Employee of the U.S. Government Abroad
- Certain Former Employees of the Panama Canal Company or Canal Zone Government
- Certain Former Employees of the U.S. Government in the Panama Canal Zone
- Certain Former Employees of the Panama Canal Company or Canal Zone Government on April 1 st , 1979
- Iraqi and Afghan interpreters/translators who have worked directly with the United States armed forces or under Chief of Mission authority as a translator/interpreter for a period of at least 12 months and meet requirements. - Iraqi and Afghan nationals who have provided faithful and valuable service while employed by or on behalf of the U.S. government in Iraq for not less than one year on or after March 20 th , 2003 and prior to September 30, 2013, or while employed by, or on behalf of the U.S. government, the International Security Assistance Force (ISAF), or a successor mission in Afghanistan for a period of not less than one year between October 7 th , 2001 and December 31, 2023, and have experienced an ongoing serious threat as a consequence of that employment. - Certain Foreign Medical Graduates (Adjustments Only)
- Certain Retired International Organization Employees
- Certain Unmarried Sons and Daughters of International Organization Employees
- Certain Surviving Spouses of deceased International Organization Employees
- Special Immigrant Juveniles (no family member derivatives; Adjustments Only)
- Persons Recruited Outside of the United States Who Have Served or are Enlisted to Serve in the U.S. Armed Forces
- Certain retired NATO-6 civilians
- Certain Unmarried Sons and Daughters of NATO-6 civilians
- Certain Surviving Spouses of deceased NATO-6 civilian employees
- Persons who are beneficiaries of petitions or labor certification applications filed prior to September 11 th , 2001, if the petition or application was rendered void due to a terrorist act on September 11 th , 2001
- Certain Religious Workers

Next Steps – Fees and Visa Application
After USCIS approves the petition, it is sent to the National Visa Center (NVC). Once received, the NVC will assign a case number for the petition. When an applicant’s priority date meets the most recent qualifying date , the NVC will instruct the applicant to complete Form DS-261 , Choice of Address and Agent. (NOTE: If you already have an attorney, the NVC will not instruct you to complete Form DS-261.) The NVC will begin pre-processing the applicant’s case by providing the applicant with instructions to submit the appropriate fees. After the appropriate fees are paid, the NVC will request that the applicant submit the necessary immigrant visa documents, including application forms, civil documents, and more. Based on your approved petition, your spouse and minor unmarried children, younger than 21, may apply for immigrant visas with you. Like you, they must also fill out required application forms, obtain required civil documents, pay the required fees, and undergo medical examinations. Same-sex spouses of U.S. citizens and Lawful Permanent Residents (LPRs), along with their minor children, are now eligible for the same immigration benefits as opposite-sex spouses. Consular officers at U.S. Embassies and Consulates will adjudicate their immigrant visa applications upon receipt of an approved I-130 or I-140 petition from USCIS . All categories of employment-based immigrant visas are issued in the chronological order in which the petitions were filed until the annual numerical limit for the category is reached. The filing date of a petition becomes the applicant's priority date . Immigrant visas cannot be issued until an applicant's priority date is reached. In certain heavily oversubscribed categories, there may be a waiting period of several years before a priority date is reached. Check the Visa Bulletin for the latest priority dates.
Fees are charged for the following services:
- Filing of Immigrant Petition for Alien Worker, Form I-140, or Petition for Amerasian, Widow(er), or Special Immigrant, Form I-360 (this fee is charged by USCIS)
- Processing an immigrant visa application, Form DS-260 (see Note below)
- Medical examination and required vaccinations (costs vary)
- Other costs may include: translations; photocopying charges; fees for obtaining the documents you need for the immigrant visa application (such as passport, police certificates, birth certificates, etc.); and expenses for travel to the U.S. Embassy or Consulate for your visa interview. Costs vary from country to country and case to case.

Note : Fees must be paid for each intending immigrant, regardless of age, and are not refundable.
Fees should not be paid to the NVC or paid at the U.S. Embassy or Consulate where you have your visa interview unless specifically requested. Applicants will be provided with instructions by the NVC on where and when to pay the appropriate fees. Do not send payments to the NVC’s address in Portsmouth, New Hampshire.
In general, the following documents are required:
- Passport(s) valid for six months beyond the intended date of entry into the United States, unless longer validity is specifically requested by the U.S. Embassy/Consulate in your country. Please review the instructions for guidance.
- Preview a sample DS-260 (6.4MB).
- Two (2) 2x2 photographs. See the required photo format explained in Photograph Requirements.
- Civil Documents for the applicant. See Documents the Applicant Must Submit for more specific information about documentation requirements, including information on which documents may need to be translated. The consular officer may ask for more information during your visa interview. Bring your original civil documents (or certified copies) such as birth and marriage certificates, as well as legible photocopies of the original civil documents, and any required translations to your immigrant visa interview. Original documents and translations can then be returned to you.
- Financial Support – At your immigrant visa interview, you must demonstrate to the consular officer that you are not likely to become a public charge in the United States. (NOTE: For applicants where a U.S. citizen or lawful permanent resident (LPR) relative filed the Form I-140 petition or where such a relative has a significant ownership interest in the entity that filed the petition, that relative must complete Form I-864, Affidavit of Support Under Section 213A of the Act , on behalf of the applicant.)
- Completed Medical Examination Forms – These are provided by the panel physician after you have completed your medical examination and vaccinations (see below).
Once the NVC determines the file is complete with all the required documents, they schedule the applicant’s interview appointment. NVC then sends the file, containing the applicant’s petition and the documents listed above, to the U.S. Embassy or Consulate where the applicant will be interviewed for a visa. The applicant, attorney, and third-party agent, if applicable, will receive appointment emails, or letters (if no email address is available), containing the date and time of the applicant's visa interview along with instructions, including guidance for obtaining a medical examination.
Each applicant should bring a valid passport to the interview, as well as any other documentation above not already provided to NVC. A consular officer will interview the applicant, and the consular officer will determine whether the applicant is eligible to receive an immigrant visa in accordance with U.S. immigration law. Ink-free, digital fingerprint scans will be taken on the day of the interview. Generally, an applicant receives original civil documents and original translations back at the time of interview.
Important Notice : In preparing for your interview, you will need to schedule and complete your medical examination and any required vaccinations before your visa interview. Before an immigrant visa can be issued, every applicant, regardless of age, must undergo a medical examination which must be performed by an authorized panel physician . NVC provides applicants instructions regarding medical examinations, including information on authorized panel physicians. U.S. immigration law requires immigrant visa applicants to obtain certain vaccinations prior to the issuance of immigrant visas. See Vaccination Requirements for IV Applicants for the list of required vaccinations and additional information.
Employment based immigrant visa cases take additional time because they are in numerically limited visa categories. The length of time varies from case to case and cannot be predicted for individual cases with any accuracy. Some cases are delayed because applicants do not follow instructions carefully. Some visa applications require further administrative processing , which takes additional time after the consular officer interviews the applicant.
Certain conditions and activities may make an applicant ineligible for a visa. Examples of these ineligibilities include: drug trafficking; overstaying a previous visa; and submitting fraudulent documents. If you are ineligible for a visa, you will be informed by the consular officer and advised whether there is a waiver of the ineligibility available to you and what the waiver process is. Attempting to obtain a visa by the willful misrepresentation of a material fact or fraud may result in you becoming permanently ineligible to receive a U.S. visa or enter the United States.
If you are issued an immigrant visa, the consular officer will give you your passport containing the immigrant visa and a sealed packet containing the documents which you provided. It is important that you do not open the sealed packet . Only the U.S. immigration official should open this packet when you enter the United States. You are required to enter the United Statesbefore the expiration date printed on your visa. When traveling, the primary (or principal) applicant must enter the United States before or at the same time as family members holding visas.
USCIS Immigrant Fee - You must pay the USCIS Immigrant Fee to U.S. Citizenship and Immigration Services (USCIS) after you receive your immigrant visa and before you travel to the United States. (SI-1, SI-2, SI-3, SQ-1, SQ-2, and SQ-3 visa holders will not pay the fee.) Select USCIS Immigrant Fee on the USCIS website for more information.
Important Notice : USCIS will not issue a Permanent Resident Card (Form I-551 or Green Card) until you have paid the fee.
A visa allows a foreign citizen to travel to the U.S. port-of-entry and request permission to enter the United States. Applicants should be aware that a visa does not guarantee entry into the United States. The DHS, U.S. Customs and Border Protection (CBP) officials have authority to permit or deny admission to the United States. Travelers should review important information about admissions and entry requirements on the CBP website under Travel .
Once you have paid the USCIS immigrant fee and have been admitted to the U.S. as a permanent resident, your Permanent Resident Card, Form I-551 (formerly called Alien Registration Card, also known as a (green card ) will be mailed to you.
If you elected on your immigrant visa application form to receive your Social Security Number Card upon admission to the United States as an immigrant, your card will be sent by mail to the U.S. address you designated on your application form, and should arrive approximately six weeks following your admission. If you did not elect to receive your Social Security Number Card automatically, you will have to apply to be issued a card following your arrival in the United States. Employment Verification Letter for Green Card
When applying for an extension of stay or lawful permanent residence from within the United States, you or your petitioning sponsor may need to provide evidence of current income or continued employment to satisfy US Citizenship and Immigration Services (USCIS) that you meet the requisite requirements for either nonimmigrant or immigrant status.
Equally, when applying from overseas, proof of financial means may be needed to satisfy your local Embassy or Consulate of your eligibility for a visitor visa, while proof of financial support may be needed for a spouse, fiancé(e) or family visa. You may also need proof of employment status to show that you meet certain job role requirements, for example, as an intracompany transferee, or as an employee of a principal visa-holder engaging in US trade or investing in a US business.
In this guide, we explain what an employment verification letter is and when they are needed for US immigration and nationality applications.
What is an employment verification letter?
An employment verification letter is a letter that can be used, or is required, to support an application for an immigrant or nonimmigrant visa. This letter could be from an existing US employer to show that you or your petitioning sponsor are currently in paid employment in the United States, as evidence of financial means, or from a prospective US employer to show that you will be working in a certain job role on the grant of a suitable work visa.
The letter is essentially designed to verify either that you have adequate means of financial support and are not likely to become a public charge in the States, or that you meet specific job role requirements for an employment-based visa. This type of letter will usually evidence the nature of the job role and salary, together with any other information that may be relevant to your immigration application. This could include, for example, whether the job is full-time or part-time, and whether it is permanent or temporary. It might also include, where relevant, the skills, experience and qualifications needed to fulfil that role.
When is an employment verification letter needed?
There are a number of scenarios in which an employment verification letter may be useful or needed in the context of an immigration application. If you are a petition-based applicant, this type of letter may need to be filed by your petitioning sponsor, along with other documents in support of the petition to USCIS. In other cases, the letter may need to be submitted with your visa application or produced to the consular officer at interview on request.
The following list is by no means exhaustive, but provides an overview of the circumstances in which an employment verification letter may be required:
Entry clearance applications
If you are looking to visit the United States, even if just for a holiday, there are strict requirements that must be met for a B-2 tourism visa, including having sufficient funds to cover your expenses and stay in the US, as well as strong ties to your country of residence to ensure your return abroad at the end of your stay. There are various ways in which these requirements can be met, although an employment verification letter can be an ideal way of showing both current income and ties to your home country. This type of letter can also be very useful evidence in the context of a B-1 business visitor visa , to provide a clear context for regular business trips to the States, such as attending meetings or closing a deal.
However, the employment verification letter can often be crucial when it comes to applications for an employment-based visa. If you are currently overseas, but looking to come to the US for the purposes of work, you will need to meet very specific employment requirements to be eligible for a work visa. This could be, for example, working for your overseas employer in a US branch or subsidiary as an intracompany transferee on an L1 nonimmigrant visa . It could also be where you will be working as the senior or essential employee of someone of the same nationality trading in the States or investing in a US business under E1 nonimmigrant classification . In either case, the employment verification letter can provide the necessary evidence of both previous and proposed employment.
In the context of the L-1A visa, you must show that you have been employed as an executive or manager for 1 continuous year in the last 3 years and be seeking to enter the US to work in an executive or managerial capacity for a branch/subsidiary of the same employer. In the context of the L-1B visa, you must again show that you have been working for a qualifying organisation abroad for 1 continuous year within the last 3 years, and will be providing services in a specialised knowledge capacity to a branch/subsidiary of the same employer.
Similarly, if you are applying for an E-1 visa as the employee of a treaty trader, or an E-2 visa as the employee of a treaty investor, you will need a detailed job description letter for the treaty trader/treaty investor business to show that you are either a senior or essential employee and will be undertaking a similar role in the States.
Extensions/change of status applications
If you are currently in the US on a nonimmigrant visa, as these are temporary in nature, your stay will be time-limited. Unless you want to leave the States and return home, you must either apply to extend your visa prior to expiry of your current authorised stay or apply to switch status. In most cases, whether applying to extend your stay or to change status, USCIS will want to see evidence that you have sufficient financial resources or financial support to pay for your ongoing expenses. You may also need to provide evidence of continued employment depending on the type of nonimmigrant visa or extension being sought.
As an L1 intracompany transferee, you will usually have permission to work in the US for 3 years, unless you have applied on the basis of establishing a new US office, in which case your initial stay will be limited to 1 year. However, L1 visa-holders can apply for extensions of stay in increments of 2 years, until you have reached the maximum limit of 7 years for L-1A executives or managers or 5 years for L-1B specialised knowledge employees. As an E-1 or E-2 senior or essential employee, your initial grant of stay will usually be limited to 2 years, but there is no limit to the number of extensions an E-1 or E-2 visa-holder may be granted, provided you maintain an intention to depart the States when your status expires. In all cases, an employment verification letter will be needed to evidence ongoing employment.
Green card applications
If you want to become a lawful permanent resident, you will need to apply for an immigrant visa or ‘green card’. There are different types of immigrant visas, but in all cases, your petitioning sponsor will be required to show that you have adequate means of financial support and are not likely to become a public charge by permanently settling in the States.
Applications for green cards can be made from both within the US or from overseas. These include a whole range of employment-sponsored visas, where evidence will be needed of either specific job offers or ongoing employment. There are also a number of family-sponsored visas, including the IR1 spouse visa, the IR2 dependent child visa or the IR5 parent visa, together with various family-preference immigrant visas. In these cases, evidence will be needed of adequate financial support in the long-term.
Other family-sponsored visas include the K-1 fiancé(e) or K-3 spouse visa, although these are strictly nonimmigrant visas but for immigration-related purposes. The K-1 visa will allow you to live with your new spouse in the States, pending the grant of permanent resident status, provided you marry within 90 days of your arrival. Similarly, the K-3 visa is designed to shorten the physical separation between you and an existing spouse, while awaiting approval of an immigrant petition to adjust your status to permanent residency. In all cases, however, the common denominator is that your petitioning sponsor must be able to provide evidence of adequate means of financial support and that you are not likely to become a public charge.
Should an employment verification letter be filed with Form I-134?
Form I-134, Declaration of Financial Support (previously known as an Affidavit of Support), is a signed statement that can be used in support of — or may be specifically requested by USCIS or a consular officer when determining — a nonimmigrant application. This is a form specifically designed to show that the applicant or beneficiary of the petition has sufficient financial resources or financial support to cover their expenses during their temporary stay.
The instructions to Form I-134 state that you may file this form on behalf of yourself or on behalf of a B (visitor), F (academic student) or M (vocational student) nonimmigrant requesting an extension of stay or change of status. The form can therefore be completed by either you, as the applicant, or by a third party who is able to support you financially. Form I-134 may also be requested to support a K-1 fiancé(e) or K-3 spouse nonimmigrant visa application, where this will usually need to be completed by the US citizen fiancé(e) or spouse.
However this form alone, even when signed with a statement of truth, will not be sufficient proof of financial resources or financial support. This means that the individual who signs Form I-134 must establish that they have both sufficient financial resources and access to those funds. An employment verification letter can be used here as proof of continued income.
Should an employment verification letter be filed with Form I-834?
When it comes to immigrant visa applications, Form I-864, Affidavit of Support, will be needed. This affidavit is required for most family-based and some employment-based immigrants to show that they have sufficient means of financial support and are unlikely to become dependent on the government for financial assistance.
This affidavit must be completed by your petitioning sponsor. This is a legally enforceable contract between a sponsor and the US Government where, by signing Form I-864, the sponsor is agreeing to use their resources to support you, if it becomes necessary. This means that the sponsor must be able to show that they have enough income or assets to maintain you and the rest of their household, where an employment verification letter, along with federal tax returns, is an ideal way of showing current income and continued employment.
What should an employment verification letter include?
The contents of an employment verification letter will very much depend on the type of immigration application and what needs to be evidenced, for example, proof of a specific employment requirement, and/or proof of financial means or financial support.
Each letter will be unique based on the requirements to be met. However, in all cases, the letter should be produced on the company letterhead to make it look official. It should also contain sufficient detail to satisfy the necessary requirements which it is intended to evidence.
There is no set format that must be followed, but for a standard financial support or financial means letter, a USCIS or consular officer would expect the letter to contain, as a minimum:
- The date the letter was written
- The name of the employee
- The employee’s position and job title
- The date employment started
- The employee’s work status, for example, whether full-time or part-time
- The employee’s annual salary or hourly wage
- Whether the job is permanent or temporary.
For employment verification letters specifically required to evidence previous or proposed employment, the letter will need to be far more detailed and technical. For example, a job description letter for an L or E visa will not only need to explain the nature and duration of the applicant’s role within the business, but also the skills, experience and qualifications needed to fulfil that role, plus the responsibilities that they have and will be expected to take on.
To be valid, any employment verification letter must be signed by the employer, providing their full name and official title. In most cases, it should also be written no more than 3 months prior to the date of the immigration application which it is intended to support.

The employment verification letter goes by other names, including proof of employment letter and verification of employment, but it is simply a request for proof that you are gainfully employed. This article will explain the different immigration processes where you’ll have to submit an employment verification letter, what the letter should say, how you can request the letter from your employer, and how to write it if you’re self-employed.

Which Immigration Processes Require an Employment Verification Letter?
Employment verification letters prove that you or your sponsor can receive certain immigration benefits. Family-based green cards, employment-based green cards, work visas, B-1 temporary business visas, and B-2 tourist visas often require these letters.
Family-Based Green Cards
If you are a U.S. citizen or permanent resident sponsoring a relative for their green card, you must complete Form I-864 , Affidavit of Support. U.S. Citizenship and Immigration Services (USCIS) is a government agency of the Department of Homeland Security (DHS). USCIS uses this form to assess whether you have the financial means to support your relative applying for a green card. If their case includes joint sponsors , each sponsor must complete the form.
With the Affidavit of Support , you’ll need to submit verification documents for your financial status. These documents may include federal income tax returns, Forms W-2 or 1099, pay stubs, and an employment verification letter. USCIS will pay close attention to your employment verification letter. This is the case especially if you switched jobs recently or if you combine your income with your spouse.
Employment-Based Green Card
Most employment-based green card applicants will need to submit an employment verification letter. You are eligible for this category if you have the appropriate work experience. This letter will be crucial if your prospective employer or new employer states that they require relevant past work experience, and most employers do.
Employment verification forms and letters for employment-based green cards should be very detailed. U.S. Citizenship and Immigration Services (USCIS) considers them with your application. This letter should describe your previous employment’s work responsibilities. You should include your formal titles and dates of employment.
H-1B visas and L-1A/L-1B intracompany transfer visas allow foreign nationals to work legally in the United States. The employment verification letter serves a different purpose for each visa type. But any letters for the work visa category should focus on your past work experience.
Not all H-1B visas require previous work experience, but U.S. Citizenship and Immigration Services (USCIS) will still need to review your complete employment history. So, they ask to review evidence, including previous résumés and an employment verification letter.
For the L-1A/L-1B visas, your eligibility depends on your fitness for the role. You must have a minimum of one year of work experience before applying.
B-1 Temporary Business Visa
The B-1 visa is for temporary business visitors to the United States. But those applying for B-1 visas must not complete labor or receive payment from U.S. sources during their time here. Most applicants include business visitors who travel to attend meetings and seminars. Other reasons include negotiating contracts with associates, serving as guest speakers, or purchasing goods and property.
A B-1 visa application requires an employment verification letter to confirm you work for a foreign employer. Your letter should describe activities you intend to take part in during your visit to the United States. The letter should state that you are traveling to the United States for a short visit. You should also indicate that you won’t be working for, or receiving payment from, U.S. sources during your visit.
B-2 Tourist visa
B-2 tourist visas permit foreign travelers to enter the United States as tourists. U.S. Citizenship and Immigration Services (USCIS) considers your ties to your home country and financial situation when you apply for this visa. They want to make sure you intend to return to your home country after your visit. They also want to ensure that you will be able to support yourself during your trip.
For these visas, you’ll need to complete Form DS-160 , Online Nonimmigrant Visa Application on the Consular Electronic Application Center website . The form will ask you about your employment history. Employment verification letters prove that you’re employed in your home country and have a job waiting for you back home. Letters also confirm that you are financially able to support your travel to the United States.
What Is Included in an Employment Verification Letter?
U.S. Citizenship and Immigration Services (USCIS) does not provide an official employment verification letter sample or template. But your employer should include all necessary information in their letter. All information in the letter must be accurate. Inaccurate statements may cause delays when USCIS processes your application. Some employers may use a standard employment verification letter template for all requests they receive from employees. If this is the case for you, make sure to provide any context about your specific situation to your employer.
Your employer should write the letter on their company letterhead and include the following:
An appropriate salutation, such as “To whom it may concern:” or “Dear [Agency Name]”
The date the employer (or self-employed applicant) wrote the letter. Note that your employer must write the letter within three months before you file your application. USCIS prefers that the date of writing the letter is closest to your filing date. This will make their job easier when evaluating your application.

Your job title(s)
Your annual salary information
Your employment classifications (full-time, part-time, temporary, contract, or another type of work frequency)
A description of the responsibilities you held during your employment
A signature line that includes the letter writer’s signature, their full name (in print letters), the company name, employee’s name, and the writer’s official title
What if My Employment Was Affected by COVID-19?
If you lost your job or your employer furloughed you because of the COVID-19 pandemic, you still need to provide the official leave notice from your employer to USCIS. The letter should list the date the employer issued your leave notice, your former employer’s name, and the date you expect to return to your job (if this is the case).
How Do I Get an Employment Verification Letter?
You may request an employment verification letter through one of the following ways:
You may ask your manager or supervisor for a letter. Be sure to provide them with context. You should let them know the type of immigration benefit you are applying for and any additional information they must include in their letter.
You may contact your employer’s Human Resources department. Many companies have formal company policies for current employee requestors of employment verification letters.
You may find an employment verification request service. This service sends your employer your request for a letter. A service can help if you’re having a hard time getting the letter from your employer. Some companies rely on services to streamline their formal letter request processes. You should ask your employer if your company uses services like InVerify or The Work Number .
Can I Write My Own Employment Verification Letter?
USCIS looks closely at sponsoring relative’s documents who are self-employed to assess their eligibility as sponsors. If you are a business owner or independent contractor, you likely won’t be able to provide USCIS with a Form W-2 to prove your financial stability. Instead, USCIS asks that you submit a verification of employment letter.
This letter should describe your current employment status and your existing business. You will have to write and sign the letter yourself. The letter should include all of the exact details that other employment verification business letters include. You should have the letter notarized to legitimize it, as you will be the one writing it.
Self-employed green card sponsors must often submit supporting evidence to prove their financial stability. This evidence includes proof of the company’s existence. Sponsors may provide state business registration documents or business account documents from their bank and other financial institutions. They may also provide copies of contracts, payment receipts, and corporate income tax return records.

Completing Section 1, Employee Information and Attestation
When completing Form I-9, Employment Eligibility Verification , you, as the employer, must make the complete instructions to the form and the Lists of Acceptable Documents available to newly hired employees.
Your employees must complete and sign Section 1 of Form I-9 no later than their first day of employment (the actual commencement of employment of an employee for wages or other remuneration, referred to as date of hire in the Department of Homeland Security regulations), but may complete Section 1 any time after they accept the job offer. Preparers and translators can help employees complete Section 1.
Note: You may review the employee’s document(s) and fully complete Section 2 at any time between the date the employee accepts the job offer and completes Section 1 to within three business days of the hire.
Employee Responsibilities for Section 1
- Employees with two last names (family names) should enter both names. Employees with two first names (given names) should enter both names.
- Employees with only one name should enter it in the Last Name field, then enter “Unknown” in the First Name field.
- Employees should include the hyphen (-) or apostrophe (’) if their names have them.
- Employees with a middle name should enter the middle initial.
- Other legal last names used, including a maiden name, if applicable.
- Current address, including street name and number city, state and ZIP code. Include the apartment number or letter if applicable;
- Date of birth;
- Citizenship or immigration status, by checking the appropriate box to indicate whether they are a U.S. citizen, a noncitizen national, a lawful permanent resident of the U.S., or a noncitizen authorized to work in the U.S.;
- If applicable, A-Number/USCIS Number, Form I-94 admission number, or foreign passport number (including country of issuance), and the date employment authorization expires; and
- Signature and the date.
Optional Employee Entries for Section 1:
- Social Security number (Exception: Employees must provide their Social Security number if you participate in E-Verify );
- E-mail address (employees may receive email notifications from USCIS if you participate in E-Verify); and
- Telephone number.
Employees must sign the form even if a preparer or translator helps them. Each preparer or translator who helps your employee must provide their name and address and must sign and date a separate certification block on Supplement A, Preparer and/or Translator Certification for Section 1.
You must retain completed supplement pages with the employee’s completed Form I-9.
The date your employee enters next to their signature should match the date the preparer/translator signed the supplement.
Employer Responsibilities for Section 1
You must review the information your employees provided to ensure:
- They completed all required fields;
- They provided their Social Security numbers if you participate in E-Verify . (If you do not participate in E-Verify, employees are not required to enter their Social Security number.);
- They signed and dated their forms; and the preparer or translator completed, signed, and dated a certification block on Supplement A and/or Translator Certification for Section 1 if the employee used a preparer or translator.
You should also:
- You may need to reverify your employee’s employment authorization when it expires. You may remind them at least 90 days before the expiration date that they will need to present a List A or List C document to show continued employment authorization for reverification purposes. They must present these documents on or before the date their current employment authorization expires.
- Check whether the expiration date for employment authorization your employee provided in Section 1 matches the expiration date of the List A or List C document they presented for Section 2, Employer Review and Attestation. Use the earlier date for reverification purposes.

Family's plight shines light on challenges with lengthy parent visa processing delays
Seok Hee Lee grew up in Australia but he will soon be forced to leave, after his visa application was declined when he aged out of the category during a six-year processing delay.

"When my family goes back, we can't really get a suitable job because we've been living here for so long," Mr Lee said.
Mr Lee and his mother immigrated to Australia from South Korea about 17 years ago to join his sister, who is now a citizen after being sponsored through hospitality work.
They have lived in Australia on bridging visas ever since.
Mr Lee's family recently sold their sushi restaurant in Henley Beach after running it for five years and he said his family's qualifications mean their financial prospects are limited.
"You can't earn as much money like this ever in Korea unless you're a really highly paid worker, like a doctor," he said.
"I have to go to the national services for two years, that is compulsory.
"I have to sort of find a job through the army."
At the start of 2017, when Mr Lee was nearly 17, his mother applied for a permanent parent visa and included him as a dependent child.
While his mother was granted residency in March this year, Mr Lee found out his visa was declined because he no longer met the age requirements.
"We bought a house mid-last year as well, now we have to sell everything," Mr Lee said.
"I miss the things that I didn't or couldn't do.
"It's huge, because I know everyone here — I even started coaching volleyball."
Migrants left in 'permanently temporary' limbo
The Lee family applied for the Contributory Parent Visa, which has far shorter processing times compared with other parent visas – but it also has an additional fee of over $40,000 once approved.
The visa requires that if a dependent is over the age of 23 at the time the decision is being made, they must prove they are "incapacitated for work" to be deemed "wholly or substantially reliant" on the primary applicant.
Mr Lee turned 23 two months before his visa application was rejected, more than six years after the application was made.
His mother decided it was not worth paying the costly fees to accept her residency if her son could not stay in the country.
According to the Department of Home Affairs' website, Contributory Parent Visas that were finalised in the 2022-23 year had a wait time of an average of six years – but the wait time for new applications has doubled.
In comparison, other parent and aged parent visas now have a processing time of nearly 29 years.
In March, a comprehensive review into Australia's immigration system, commissioned by the Federal Government, found that the country relies too heavily on temporary migrants, without offering clear pathways to permanent residency.
It also identified immigration backlogs as a major issue.
The review found community confidence had been "undermined" in the migration system.
"Had they been asked, it is hard to conceive of Australians willingly agreeing to the creation of a 'permanently temporary' cohort of workers, akin to guest-workers seen in some other countries," the review said.
The federal government has outlined a revised Migration Strategy in response to the review, taking on some key recommendations.
But, while it recognised the need to reform the parent visa program, it said it would be considered separately.
The final Migration Strategy is expected to be released later this year.
A Department of Home Affairs spokesperson said almost 600 new staff were recruited in the last financial year and are supporting temporary and migration visa processing.
"Total on-hand applications, including permanent visas subject to migration program planning levels, are almost 40 per cent lower than the nearly 1 million on-hand in June 2022," the spokesperson said.
Migration expert and associate professor at Sydney University, Anna Boucher, said the federal government faced a "challenging" situation.
"Also, visa applications have increased at the same time as they are trying to clear the backlog," Dr Boucher said.
"Ideally, they would get the backlog down to the hundreds of thousands, so hiring more staff would be good."
Parent visas need 'attention and improvement'
Ms Boucher said many migrants on temporary visas would feel they were in a "state of flux" while the government undertakes a "massive overhaul of the migration system".
"We know that temporary migrants don't have access to the social security system or Medicare," she said.
"I don't think that's going to change any time soon.
"But at least clear communication about the stages, any transitional arrangements, is very important."
Migration lawyer Zefy Souvlakis said while Mr Lee's case was not common, lengthy processing times posed challenges for children included on parent visas.
"It is an area that requires attention and improvement," she said.
"Especially for the contributory parent visa, where applicants are required to contribute a large amount of funds in government charges to allow for what is expected to be faster processing."
For now, Mr Lee and his family will have to try and adjust to their lives in Korea.
He said he felt like the visa was a "little bit of a waste of time".
"I had school, I had work," he said.
"Everything seems to have changed now."
